Terms and Conditions – Private Gym Facility

Gym Name: The Fitt Collective
1. Introduction
These Terms and Conditions (“Terms”) govern your use of The Fitt Collective (“the Gym”, “we”, “us”, “our”). By purchasing a membership or using our facilities, you agree to be bound by these Terms.
2. Membership Eligibility
- Members must be aged 18 or over, unless enrolled under a supervised junior programme.
- You confirm that you are physically fit to participate in exercise.
- You must inform us of any medical conditions that may affect your ability to exercise safely.
3. Opening Hours
- The Gym operates between 6:00am and 9:00pm Mon - Friday and 7am and 3pm Sat & Sun.
- We reserve the right to amend opening hours for maintenance, holidays, or special circumstances. Reasonable notice will be given where possible.
4. Access and Use
- Access is limited to registered members and personal training clients only.
- Your membership is personal and non-transferable.
- You may be required to use an access card, key fob, or digital check-in system.
- You must not allow entry to non-members (“tailgating”).
5. Health and Safety
- You agree to use all equipment responsibly and follow staff instructions where provided.
- Appropriate gym attire and footwear must be worn at all times.
- You must wipe down equipment after use and maintain hygiene standards.
- Any injuries, accidents, or unsafe conditions must be reported immediately.
- We reserve the right to refuse access if we believe you are under the influence of alcohol or drugs.
6. Personal Belongings
- Storage facilities are provided but are used at your own risk.
- The Gym accepts no responsibility for lost, stolen, or damaged personal items.
7. Membership Fees and Payments
- Membership fees must be paid in advance via the agreed payment method.
- Failure to make payment may result in suspension or termination of membership.
- Fees are non-refundable except where required by law.
8. Cancellations and Termination
- You may cancel your membership by providing 1 month's written notice.
- We reserve the right to terminate membership immediately if you breach these Terms or behave inappropriately.
- No refunds will be issued for unused membership periods unless required by law.
9. Code of Conduct
Members must:
- Respect staff and other members
- Use equipment appropriately
- Avoid disruptive, abusive, or unsafe behaviour
Failure to comply may result in suspension or termination.
10. CCTV and Security
- CCTV operates within and outside the facility for safety and security purposes.
- Footage may be used to investigate incidents and prevent misuse.
11. Liability Disclaimer
- You use the Gym and its facilities at your own risk.
- We are not liable for injuries sustained except where caused by our negligence.
- Nothing in these Terms excludes liability for death or personal injury caused by negligence or any other liability that cannot be excluded under UK law.
12. Changes to Services
- We may alter or withdraw facilities, classes, or equipment at any time for operational reasons.
- We will aim to minimise disruption where possible.
13. Data Protection
- Your personal data will be handled in accordance with our Privacy Policy.
- By becoming a member, you acknowledge that you have read and understood our Privacy Policy.
14. Complaints
- Any complaints should be submitted in writing to nathan@thefittcollective.co.uk
- We will aim to respond within a reasonable timeframe.
15. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
